1. Heard learned senior counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 302, 201, 120(B) and 34 of the Indian Penal Code.

3. From perusal of the office report dated 21.11.2024, it would manifest that the same records that supplementary case diary instead of original case diary has been received. The Court will not wait endlessly for the case diary.

4. The learned senior counsel for the petitioner submits that son of the petitioner namely Nitin Kumar had approached this Court seeking anticipatory bail by filing Cr. Misc. No.60240 of 2024 and the same was allowed by an order

Patna High Court CR. MISC. No.65328 of 2024(3) dt.22-11-2024 2/2 dated 26.09.2024 after considering the case on merits and in detail. It is further submitted that the case of the petitioner is on a better footing and the petitioner also suffers from disability of 40 per cent.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned senior counsel for the petitioner and also taking into consideration the order dated 26.09.2024 in Cr. Misc. No.60240 of 2024, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Hariharnath P. S. Case No.30 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
