2. The petitioners are defendants of Title Suit No.35 of 2008 pending in the Court of Sub Judge-Ist, Banka. The present application has been filed for setting aside the order dated 22.01.2014 whereby the prayer of the petitioners to abate the suit under Section 4(C) of Consolidation Act was rejected and the suit was fixed for settlement of issues. In this regard, I would like to refer a notification bearing Misc.-09-03/15, Memo No.54 dated 19.01.2018 whereunder

Patna High Court CWJC No.18182 of 2014 dt.18-07-2018 2/2 the notification issued under Section 3(1) of Bihar Consolidation of Holding and Prevention of Fragmentation Act, 1956 has been cancelled. In view of said notification, the suit has revived.

3. In view of above facts, this application has become infructuous and is accordingly dismissed.
