The petitioners seek anticipatory bail in connection with Mojahidpur (Babbarganj) P.S.Case No. 223 of 2018, registered for offences punishable under Sections 326, 307/34 of the Indian Penal Code and Sections 3,4 and 5 of Explosive Substance Act.

As per F.I.R., allegation against the petitioners is of explosion of bomb and when the police party proceeded towards the place of occurrence and found that blood was spread there and one person sustained injuries. Submission of the learned counsel for the petitioners is that nothing has been recovered from the possession of the petitioners and the informant himself stated in the written

No.80062 of 2018(3) dt.19-02-2019 2/2 complaint that no one had stated the name of petitioners rather he gathered the information from unknown persons and the petitioners are the student, who have not concern with the antecedent.It is further submitted that the petitioners have clean antecedents.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each in connection with Mojahidpur (Babbargaj) P.S.Case No. 223 of 2018 to the satisfaction of learned S.D.J.M., Bhagalpur, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
