02. The present criminal writ petition has been filed by the petitioner seeking following relief(s): "A. For directing the Respondent Authorities to take proper steps for the

2/4 protection of the life and property of the Petitioner from the Private Respondent who in connivance with the Station House Officer Nauhatta, Rohtas alongwith some antisocial elements / extremists are trying to dispossess the Petitioner from his Raiyati Land for which the Private Respondent are forcefully constructing road over the land of the Petitioner.

B. For directing the Respondent No.2 & 3 to take proper steps on the application submitted by the Petitioner and further a proper direction may be issued to the other Respondent Authorities to make ensure that the proper action should be taken on the complaint /application submitted by the Petitioner as the Private Respondents are making construction of road forcefully over the Raiyati land of the Petitioner with the extremist and the Station House Officer, Nauhatta, Rohtas C. For directing the Respondent Authorities to make ensure that no further construction of illegal road should be done by the Private Respondents with the help of extremist groups during the pendency of the present writ application over the land of the Petitioner.

D. For directing the Respondent Authorities to provide opportunity of the Petitioner for Redressal of his grievances and further a proper decision / direction/Order may

3/4 be passed in order to maintain Rule of Law in the society.

E. For grant of any other relief or reliefs in view of the facts and circumstances of the case for which the Petitioner is entitled too."

Learned counsel for the petitioner submits that petitioner is having title and possession over his Raiyati land bearing Khata No. 193, Plot No. 991, area 40 acres and 11 acres 82 decimal having Fasli Nos. 137/88 and 74/83. The court of learned Munsif-II, Sasaram in Title Suit No. 74 of 1983 declared the title and possession of the petitioner and other plaintiffs over the said land. Now, the private respondent nos. 8 and 9, in connivance with the State authorities, are trying to carve out a Rasta from the land of the petitioner and though emails have been sent to the Secretary, Home Department, Government of Bihar, Patna and the Director General of Police, Government of Bihar, Patna, no action has been taken. Learned counsel further submits that the petitioner would be satisfied if the present writ petition is disposed of with direction to the concerned authorities to act upon the representations given to them and action is taken upon the complaint of the petitioner.

04. I find the prayer of the learned counsel for the petitioner to be quite reasonable.

05. Learned counsel appearing on behalf of Respondents-State submits that the petitioner has a remedy available and he can take recourse of Section 163 of BNSS.

06. Be that as it may, the State authority could consider the representations of the petitioner sent through e-mail and take appropriate step in accordance with law.

07. With the aforesaid direction, the present petition stands disposed of.
