The petitioner seeks regular bail in connection with Excise case no. 324C2 of 2018 registered for the offence punishable under Section 30(a) of Bihar Excise and Prohibition Act, 2016.

The allegation is regarding recovery of 144 liters of illicit liquor from Tata Sumo vehicle and the petitioner is said to have been apprehended from the spot.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having clean antecedent and he is languishing in custody since

Patna High Court Cr.Misc. No.80219 of 2018(2) dt.25-01-2019 2/2 22.11.2018. Lastly, it is submitted that the petitioner is neither the owner nor the driver of the said vehicle Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J. 2nd, Jamui in connection with Excise case no. 324C2 of 2018.
