2. The petitioners have preferred this application for grant of regular bail in connection with Sasaram (M) P.S. Case No. 248 of 2018 dated 7.12.2018 registered for the offences punishable u/s 30(a), 34 and 38 of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 2073.6 litres of illicit whiskey is alleged to have recovered from the Dalan of the coaccused Tulsi Singh.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioners. The petitioners have no concern with

Patna High Court CR. MISC. No.65015 of 2023(2) dt.12-10-2023 2/2 the alleged recovery. The recovery is from the Dalan of the coaccused Tulsi Singh. The co-accused person Tulsi Singh has already been granted bail by the Coordinate Bench of this Court vide order dated 5.4.2019 passed in Cr. Misc. No. 5821 of 2019. The petitioners are accused in two other criminal cases as stated in para 3 of the bail petition. The petitioners are in custody since 18.8.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners by submitting that the petitioners are involved in the business of illicit liquor.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bail-bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Rohtas at Sasaram in connection with Sasaram (M) P.S. Case No. 248 of 2018.

7. The application stands allowed.
