The petitioner apprehends his arrest in Madanpur P.S. Case No. 201/2011, registered for the offences punishable under Section 307 of the Indian Penal Code and section 27 of the Arms Act.

The informant alleged that while he was returning to his house at about 7.45 in the night he was shot from behind by the son of Bihari Sao.

Learned counsel for the petitioner submits that petitioner is not the son of Bihari Sao. The petitioner is the son of the informant Kishun Sao, but it appears from perusal of the case diary that during the course of investigation, almost all the witnesses have stated that the petitioner, who happens to be the

Patna High Court Cr.Misc. No.29504 of 2017 (3) dt.21-08-2017 2/2 son of the informant from his first wife, shot the informant. The police has already attached the property of the petitioner under Sections 82 and 83 Cr.P.C. as the petitioner has already been declared absconder.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
