Both the petitioners, who are son and father, have been granted provisional bail by this Court on 19.10.2022 on their assurance to deposit a draft of Rs. 40,00,000/- (forty lakhs) in favour of the informant, whereas a draft of Rs. 10,00,000/- (ten lakhs) was filed on that date (19.10.2022). The learned counsel for the petitioners has submitted that a draft of Rs.40,00,000/- (forty lakhs) was filed on 07.01.2023 in the court which has been received by the

Patna High Court CR. MISC. No.197 of 2022(17) dt.15-05-2023 2/2 informant. So far as the draft in respect of Rs.10,00,000/-(ten lakhs) is concerned, it has been filed in the court below itself. So far as the rest amount is concerned, in anticipatory bail petition being Cr.Misc.No. 27282 of 2022 and its another analogous case, two co-accused persons, namely, Parwati Dvi and Nilesh Kumar have been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 14.03.2023 on their assurance that they would return Rs.1,31,00,000/-(Rupees one crore thirty one lakh) out of total amount of Rs.1,81,00,000/- to the informant within a period of one year. They had submitted at the time of hearing of the anticipatory bail petition that the petitioners had already returned Rs. 50,00,000/- (Rupees fifty lakhs) to the informant. Considering the above facts and circumstances as well as the words given by the co-accused persons in Cr.Misc.No.27282 of 2022 and its another analogous case, the provisional bail dated 19.10.2022 granted to the petitioners is hereby confirmed.
