This is a petition for grant of anticipatory bail for offence under Sections 302, 201 and 34 of the Indian Penal Code.

The informant is not an eye witness of the occurrence. Allegation is against eight first information report named accused persons that they have committed murder of the son of the informant. The petitioner is wife of the step son of the informant.

Submission of the learned counsel for the petitioner is that the case diary would reveal that there is no eye witness of the occurrence and only for land dispute there is suspicion against the petitioner. The petitioner is a female.

The learned Public Prosecutor concedes that there is no eye witness of the occurrence.

Considering the aforesaid facts and circumstances, the petitioner, above named, in the event of her arrest or surrender, within four weeks from the date of receipt of this order, be

Case No. 26 of 2016 to the satisfaction of the Subdivisional Judicial Magistrate, Udakishunganj, Madhepura, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
