The petitioners apprehend their arrest for the offences alleged under Section 304B/34 of the Indian Penal Code registered in connection with Dhansoi P.S. Case No. 101 of 2019.

The prosecution case is that on 04.06.2019 the informant married her daughter with one Manish Kumar son of Chunnu Ram and soon after the marriage within one month, the demand of dowry was made by the in-laws. It is further stated

No.66214 of 2019(2) dt.15-11-2019 2/3 that father-in-law Chunnu Ram demanded rupees five thousand and one T.V.S. motorcycle from the husband of the informant and he also warned that if the aforesaid articles were not provided then he would kill her daughter. It is further alleged that on 04.07.2019 all the petitioners killed the daughter of the informant by setting her on fire and informed the informant after two days by saying that the daughter of the informant died due to stomachache.

Learned counsel for the petitioners submits that there is no specific allegation against petitioner nos. 2 to 4 and the allegation has been made against Chunnu Ram. It is further submitted that the husband of the deceased in custody. Petitioner no. 1 is the father-in-law of the deceased whereas petitioner nos. 2 and 3 are uncles-in-law of the deceased and petitioner no. 4 is the mother-in-law of the deceased.

Considering that there is specific allegation against petitioner no. 1 Chunnu Ram, I am not inclined to grant anticipatory to him. The application, as against petitioner no.1 Chunnu Ram, is dismissed.

So far as petitioner nos. 2, 3 an 4, namely, Santosh Ram, Jitendra Ram and Sita Muni Devi are concerned, in the facts and circumstances of the case, in the event of their arrest

Patna High Court CR. MISC. No.66214 of 2019(2) dt.15-11-2019 3/3 or surrender before the court below within six weeks from the date of communication of this order, let them be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of Mr. Sukul Ram, learned Additional Chief Judicial Magistrate-III, Buxar in connection with Dhansoi P.S. Case No. 101 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) BT/- U T
