2. This is the second attempt of the petitioner for grant of regular bail in connection with S.Tr. No. 285 of 2024 arising out of Sarai P.S. Case No. 283 of 2023 registered for the offence under Sections 406, 420, 387, 307, 467, 468, 471, 504, 506/34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner along with other criminals reached the house of the informant and started firing and threatened the informant that he should not demand any money from him and they themselves demanded Rs. 3 Lakhs.

4. Learned counsel for the petitioner submits that though already the charge has been framed on 29.7.2024 but not a single witness has been examined in this case. He further submits that there is earlier case against the prosecution in

Patna High Court CR. MISC. No.66325 of 2024(3) dt.20-12-2024 2/2 which the petitioner is a witness and because of that, he has been made accused in this case.

5. Learned senior counsel for the petitioner further submits that no one was injured and it is a case of firing only.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-XIV, Vaishali at Hajipur/concerned Court below in connection with S.Tr. No. 285 of 2024 arising out of Sarai P.S. Case No. 283 of 2023.

8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Sarai Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.
