JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-07-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 379/506/34 of the Indian Penal Code.
Prosecution case is that co-accused Nagmani Yadav demanded ransom of Rs.2.50 lacs from the informant and when she did not pay the same, said co-accused and the petitioner went to the newly constructed house of the informant and again demanded the ransom amount and took away Rs.500/- from the pocket. In the night they destroyed the north wall of the boundary and took away the construction materials. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to land dispute going on between the parties. The
Patna High Court CR. MISC. No.939 of 2022(2) dt.21-07-2022 2/2 present case is counter blast of Arwal Police Station Case No. 196 of 2019 which was filed by the petitioner alleging therein that informant and others took away sacks of cement and iron bars and Rs. 1500/- and demanded ransom of Rs.1 lac from the petitioner. Petitioner has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in Arwal Police Station Case No. 191 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
