JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-04-2015 It is submitted that petitioner no.1 has been arrested, hence his application with regard to anticipatory bail has become infructuous.
Accordingly, the application with regard to petitioner no.1 is disposed of.
The petitioner no.2 is apprehending arrest in a case registered for the offences punishable under Sections 467, 468, 420 and 380 of the Indian Penal Code.
It is alleged that Rs. 4.95 lacs were awarded from the NTPC in pursuance to the acquisition of the land. The said money was deposited in the joint account of petitioner no.1 and the informant but subsequently petitioner no.1 withdrew the said amount. Considering the fact that the thrust of accusation is against petitioner no.1 who has already been arrested, let the above named petitioner no.2 be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Lakhisarai in connection with Piri Bazar P.S.
