The petitioners apprehend their arrest in Complaint Case No. 456 of 2006 (T.N. 2383 of 2014), registered for the offences punishable under Section 498A of the Indian Penal Code and under Sections 3/4 of the Dowry Prohibition Act. It has been submitted that the petitioners are in-laws of the complainant, but from perusal of the record, it appears that the case is of the year 2006 and the court has already exhausted all process for appearance of the petitioners and thereafter, the petitioners have been declared absconder.
Since the petitioners are declared absconder, I am not
Patna High Court Cr.Misc. No.16047 of 2015 (2) dt.28-04-2015 2/2 inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit taking into account that the petitioners are in-laws of the complainant and disposed of the bail petition preferably on the same day.
