JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 14-06-2017 Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in Rajiv Nagar P. S. Case No. 127 of 2014 registered for the offences under Sections 147, 148, 149, 341, 323, 307, 427 and 379 of the Indian Penal Code.
As per the prosecution case, accused persons assaulted the informant, his son and niece by means of lathi, danda and kudal. They also resorted to firing by means of fire arm.
It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. He has committed no
Patna High Court Cr.Misc. No.18297 of 2017 (2) dt.14-06-2017 2/2 offence and he has been falsely implicated in the case. He has been made accused in this case only after filing a petition for release of his rifle said to have been seized in the occurrence. No one has sustained any fire arm injury.
Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in Rajiv Nagar P. S. Case No. 127 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
