In the present modification application the petitioner seeks modification of order dated 09.09.2015 passed by this Court in Cr. Misc. 31880/2015 as the petitioner could not surrender within the afore-mentioned period.

It is submitted that the said act of not surrendering was not deliberate, but he was prevented due to exceptional circumstances.
