1. Heard the parties.
2. The petitioners apprehend their arrest in connection with Shahpur PS Case No. 361 of 2023 dated 07-08-2023 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
3. As per the First Information Report Police upon secret information that petitioners were carrying liquor in a Car bearing registration no. BR1AC-2652 and were coming to Bihia side, put a barrier for vehicle checking and thereafter one vehicle dashed with a pole on the road and the persons sitting therein fled away however upon search 216
Patna High Court CR. MISC. No.63794 of 2023(2) dt.18-10-2023 2/3 liters of I.M.F.L. has been recovered from the car in question.
4. Learned counsel for the petitioners submits that petitioners have been made accused on the basis of secret information received by the Police. The car from where the illicit liquor has been recovered does not belong to the petitioners as stated in paragraph no. 6 of the bail application. He further submits that no illicit liquor has been recovered from the conscious possession and / or vehicle belonging to the petitioners.
5. Regard being had to the submission made by the parties, taking into consideration the fact no illicit liquor has been recovered from the vehicle owned by the petitioners and / or from their conscious possession, as such, I am inclined to grant anticipatory bail to the petitioners.
6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10000/- (rupees ten thousand) each with two sureties of the like amount each to
