====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 23-10-2019 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner seeks bail in a case for the offence registered under Sections 302 and 120(B) of the IPC. The prosecution story, in brief, is that on 17.11.2015 at about 9.30 A.M. petitioner alongwith other F.I.R. named accused persons and 4 unknown persons came and took the husband of the informant from the house of Bakhtiyarpur Hat for giving money. Subsequently in the evening about 5.00 P.M. she got information by villagers that her husband was killed and his dead body was thrown near Mekra Kanhaipur Village and also claimed that F.I.R. named accused persons killed her husband under conspiracy.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since

Patna High Court CR. MISC. No.59218 of 2019(2) dt.23-10-2019 2/2 02.07.2019. The petitioner has got no criminal antecedent. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. It is a case of last seen. There is no eye witness to the alleged occurrence. Except for this there is no substantive evidence to suggest the implication of the petitioner in the present case. Other co-accused has been granted bail by another Co-ordinate Bench of this Court vide Cr. Misc. No. 42796 of 2016 under order dated 03.03.2017.

On behalf of the State and informant, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Barh, Patna, in connection with Mokama P.S. Case No. 225 of 2015.
