JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-07-2022 At the outset, learned counsel for the petitioners submits that petitioner no. 1 namely Md. Iftekhar Ansari has been surrendered before the court below and as such, he seeks permission to withdraw this petition so far as petitioner no. 1 is concerned.
Accordingly, in respect of petitioner no. 1, this petition is dismissed as withdrawn.
Now, sole petitioner i.e. petitioner no. 2 apprehends his arrest in a case registered for the offence under Sections 413, 414, 34 of the Indian Penal Code.
As per the prosecution case, one stolen motorcycle has been recovered from the husk house, which is situated behind the house of this petitioner and co-accused Md. Iftekhar

It is submitted on behalf of petitioner that the husk house, where from stolen motorcycle has been recovered, does not belong to this petitioner, rather the said house belongs to Md. Mannan, who is in jail. Petitioner has got no concern either with the stolen motorcycle or husk house. Petitioner has got clean antecedent.
Learned A.P.P. for the State has opposed the bail petition.
Considering the fact and circumstances, let petitioner no. 2 namely Md. Saddam Ansari, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Banmankhi P.S. Case No. 264 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
