For the Petitioner/s : Mr. Rabindra Prasad Singh For the Opposite Party/s : Mr. Chandra Bhushan Prasad(App) ====================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 09-06-2015 The two petitioners are mother-in-law and father-inlaw respectively of the victim lady who apprehend arrest in Rahui Police Station Case No 250 of 2014 instituted under Sections 304B/34 of Indian Penal Code.
It is alleged that within three months of the marriage, the victim lady was found dead by hanging. Petitioners alleged that she had, out of humiliation, committed suicide. Case diary was called for. Learned counsel for the petitioners draws attention of this Court to the statement of the informant, as recorded in course of investigation as contained in paragraph 16 of the case diary, wherein there is reference to the fact that there being no toilet in the house, the lady used to dirty the rooms inside the
Patna High Court Cr.Misc. No.14516 of 2015 (4) dt.09-06-2015 house humiliating everybody and it is because of these reasons that she had become desperate and when the informant was called, she committed suicide. It is stated that the husband of the victim has already surrendered.
Be that as it may, in the event of their arrest or surrender within four weeks from today, the petitioners abovenamed shall be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in Rahui (Bhagan Bigha) PS Case No 250 of 2014 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
