The petitioner had moved a petition for grant of regular bail earlier by way of Cr. Misc. no. 22509 of 2018, however the same was permitted to be withdrawn vide order dated 28.06.2018 with liberty to renew the prayer for regular bail after a period of six months.

The present case is a second attempt on behalf of the petitioner for grant of regular bail in connection with Uchkagaon PS case no. 128 of 2017 registered for the offences punishable under Sections 363, 366(A)/34 of Indian Penal Code. The allegation levelled in the fardbeyan is regarding the petitioner and other co-accused persons having kidnapped the victim girl.

No.724 of 2019(3) dt.09-05-2019 2/2 The learned counsel for the petitioner, by referring to the statement of the victim girl made under Section 164 Cr.P.C., has submitted that as far as the petitioner is concerned, there is no allegation of sexual assault against him, whereas co-accused persons namely Sonu and Sah Fahad, who are alleged to have established physical relationship with the victim girl, have already been granted bail by the co-ordinate Benches of this Court vide order dated 02.01.2019 passed in Cr. Misc. no. 74528 of 2018 and the order dated 16.05.2018 passed in Cr. Misc. no. 7704 of 2018 respectively.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-IX, Gopalganj in connection with Uchkagaon PS case no. 128 of 2017.
