ANJANA MISHRA ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 14.07.2015 in connection with Muzaffarpur Town P.S. Case No. 189/2015, registered for the offences punishable under Sections 376, 511 of the Indian Penal Code, Section 3(1)(X)(XI) of the SC/ST (POA) Act and Section 8 of POCSO Act, 2012.

Learned counsel for the petitioner submits that taking into consideration all facts and circumstances, no offence is said to have been made out against the petitioner. It is further submitted that the petitioner is ready to face trial so as to facilitate the prosecution case.

Considering the aforementioned facts and that the petitioner has no criminal antecedent, let the petitioner be released

Patna High Court Cr.Misc. No.3889 of 2016 (2) dt.11-02-2016 2/2 on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Spl. Judge POCSO, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No. 189/2015. It is made clear that the petitioner shall not absent himself in the court below for more than two consecutive dates without any reasonable cause and in the event of such absence, the bail bond of the petitioner shall be cancelled.
