The petitioner seeks bail in connection with Raghunathpur P.S. Case No. 163 of 2019 instituted for the offences under Section 30(a) of the Excise Act. Learned senior counsel for the petitioner submits that the petitioner is in custody since 12.08.2021, charge-sheet has been submitted in the case and has antecedent of five cases. Learned senior counsel for the petitioner submits that allegation is of total recovery of 1942.920 litres of liquor form a truck, Santro Car and a motorcycle.

Learned senior counsel for the petitioner submits that the petitioner was not arrested from the spot and his name transpired during the course of investigation. Learned senior

Considering the fact that the petitioner is in custody since 12.08.2021, charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge 2nd cum-Special Judge, Excise, Siwan in connection with Raghunathpur P.S. Case No. 163 of 2019.
