The impugned order, dated 24.09.2014, is set aside. The
Patna High Court LPA No.1547 of 2014 dt.09-05-2017 2/2 matter is remanded back to the Learned Single Judge for deciding the matter afresh on the merits, preferably at the stage of admission itself. This order is necessitated in view of the fact that admission of the writ application with no restraint order to the competent authority to proceed with appointment would virtually makes the writ application infructuous for all practical purposes. Appeal is allowed.
