The petitioners are apprehending arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code.
The accusation is of abducting the minor daughter of the informant. In the statement recorded under section 164 of the Cr.P.C. the victim girl suggested that the she went to the company of Israfil and Saddam and, thereafter, at Delhi she went to the company of one Chandan though five accused were also travelling in the same train through which she went to Delhi. It is submitted by learned counsel for the petitioners that for the occurrence of 04.11.2014, the FIR was registered on
Patna High Court Cr.Misc. No.13414 of 2015 (2) dt.06-05-2015 2/2 13.11.2014. The medical opinion suggests no injury and the doctor assessed the age of the victim between 19-21 years. It is submitted by learned counsel for the informant that the petitioners are named in the First Information Report. Considering the 164 statement of the victim girl, which suggests that the victim went in the company of Saddam and Israfil of her own, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S. Case No.826 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
