JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-06-2017 Heard the learned counsel for the petitioners and the learned Additional P.P. for the State.
The petitioners seek anticipatory bail in connection with Kishanganj P.S. Case No. 444 of 2015, registered for the offence punishable under Sections 341, 323, 324, 307, 379 and 354/34 of the Indian Penal Code.
The allegation against the petitioner is with regard to beating the informant on account of matrimonial dispute. The learned counsel for the petitioners submits that the settlement has been reached at and the petitioners have undertaken not to torture the informant any further. It has been further submitted that the informant has made statement before the learned court below under Section 164 Cr. P. C. to the effect that
Patna High Court Cr.Misc. No.17825 of 2017 (2) dt.15-06-2017 2/2 she would not pursue the matter further as the matter has been settled and the accused persons had undertaken not to torture her. Having regard to the facts and circumstances of the case, I deem it fit and proper to grant anticipatory bail to the petitioners.
Accordingly, in the event of his arrest or surrender in the Court below within a period of four weeks from today, let the above named petitioners be enlarged on bail on furnishing bailbonds of Rs. 20,000/- each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 444 of 2015, subject to the conditions laid down under Section 438(2) Cr. P. C.
