====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 01-10-2024 Heard Mr. Praveen Ranjan, learned counsel appearing on behalf of the petitioner and Mr. Nagendra Prasad, learned APP for the State.

2. The petitioner seeks regular bail in connection with Jandaha P.S. Case No. 103 of 2022 for the offence punishable under Section 304 of the Indian Penal Code.

3. Considering the nature of allegation and the fact that the petitioner switched on the transformer on the order of the higher authorities who have not been named in the F.I.R. and a result of the same, brother of the informant got burnt severely and died in course of treatment, I am not inclined to enlarge the petitioner on bail.

4. The Managing Director of the concerned Power Holding Company must consider that public safety is paramount

Patna High Court CR. MISC. No.66190 of 2024(2) dt.01-10-2024 2/2 and action is required against all the higher authorities for their negligence, on whose direction, the petitioner had switched on the transformer, while the brother of the informant was working.
