The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379/411 of the Indian Penal Code.

The present case was registered on suspicion, during investigation, after informant's motorcycle was stolen by some unknown persons. Subsequently, the motorcycle was recovered, for which Nawada Town P.S. Case No.108 of 2013 was registered, in which the petitioner was made accused and has been granted bail.

It is submitted on behalf of the petitioner that the alleged motorcycle was not recovered from his possession although the same was recovered from the possession of co-

Patna High Court Cr.Misc. No.12759 of 2015 (2) dt.26-03-2015 2/2 accused Mustkim.

The aforesaid facts and nature of accusation constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Nawada Town P.S. Case No.74 of 2013, pending before the Chief Judicial Magistrate, Nawada.

With the above observation, this application is, accordingly, disposed off.
