The petitioners seek bail in a case registered under Sections 302, 201/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons shot at the nephew of the informant.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 15.06.2019 and have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. Specific allegation of assault is alleged

Patna High Court CR. MISC. No.57743 of 2019(2) dt.23-10-2019 2/2 against the co-accused Manjit Singh, Saroj Singh, Vikash Singh and Kedar Pandey. The petitioner is alleged to be the member of unlawful assembly. Except for this, there is no other substantive evidence to suggest his implication in this case. No allegation of assault is alleged against the petitioner. Other co-accused have been granted bail vide Cr.Misc.No.79255 of 2019 and Cr.Misc.No.59277 of 2019.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sasaram in connection with Nokha P.S. case No.188 of 2018.
