The petitioner seeks bail in Bihpur (Jhandapur) P.S. Case No. 292 of 2018 registered under Sections 302, 201 & 120-B/34 of the Indian Penal Code.
A dead body of an unidentified lady was found in the bush.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner has committed no offence and has no concern with the aforesaid occurrence. He has been falsely implicated in this case. The petitioner is not named in the F.I.R. There is no eye witness of the occurrence. There is nothing on record indicating the

Mina Devi @ Meena Devi has already been enlarged on bail by a co-ordinate Bench of this Court vide order dated 06.02.2019 passed in Cr. Misc. No.80166 of 2018 and coaccused, Mukesh Yadav, who happens to be husband of the deceased, has also been enlarged on bail by a co-ordinate Bench of this Court vide order dated 20.12.2018 in Cr. Misc. No.72523 of 2018. The petitioner has no criminal antecedent and has been languishing in custody since 17.09.2018.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Naugachia, Bhagalpur /Successor Court in connection with Bihpur (Jhandapur) P.S. Case No.292 of 2018 (G.R. No.1075/2018).
