JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-02-2015 Heard the learned counsel for the petitioner, the learned A.P.P as also learned counsel for the informant. The petitioner seeks bail in a case for the offences punishable under sections 363, 366/34 of the I.P.C Allegedly the minor daughter of the informant was kidnapped and in the FIR suspicion has been alleged against Sushil Kumar Tanti and Santosh Das. After investigation the victim has been recovered and her statement has been recorded under section 164 Cr.P.C. wherein she has alleged against the petitioner that he was instrumental in her kidnapping and further the petitioner handed over the victim girl to one unknown person after taking Rs. 50,000/-
Patna High Court Cr.Misc. No.45750 of 2014 (2) dt.18-02-2015 2/2 Submission is of false implication and that other coaccused have been allowed bail and the petitioner is suffering in custody since 26.06.2014 having no criminal antecedent, to which the learned A.P.P. duly assisted by the learned counsel for the informant opposes prayer for bail by submitting that the petitioner is the main accused and he has kidnapped the victim girl. Considering the submissions urged at the bar, going through the F.I.R. and the statement of the victim recorded under section 164 Cr.P.C. and noticing that the victim girl has stated the name of the petitioner that he was instrumental in her kidnapping and as such this Court is not inclined to release the petitioner on bail and accordingly his prayer for bail stands rejected in connection with Muffasil P.S. Case No. 141 of 2014 pending in the court of C.J.M. Begusrai.
