The petitioner is accused in connection with Gopalpur (Rangra) P.S. Case No. 89 of 2015 (G.R. No. 446 of 2015) registered under sections 341, 323and 304(B)/34 of the I.P.C. pending in the Court of A.C.J.M., Naugachia, Bhagalpur. The accusation is of killing of daughter of the informant by her husband in-laws administering poison due to non-fulfillment of demand of dowry.
Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case and is in custody since 21.07.2015, having no criminal antecedent.
Patna High Court Cr.Misc. No.1715 of 2016 (3) dt.01-03-2016 2/2 Learned counsel appearing on behalf of the Additional Public Prosecutor vehemently opposed the prayer of the petitioner.
Admittedly, petitioner is husband of the deceased, who died within seven years of her marriage in an un-natural death at her Sasural.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner for bail is rejected.
