The petitioner seeks regular bail in connection with Harlakhi P.S. Case No. 203 of 2018 registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The case of the prosecution is regarding the Police having apprehended the petitioner and others after they were found carrying load on their head whereupon search was made and illicit Nepali Soufi wine to the tune of 210 litres was recovered.
The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present
Patna High Court Cr.Misc. No.2080 of 2019(2) dt.17-01-2019 2/2 case. Lastly, it is submitted that the petitioner is having a clean antecedent and is languishing in custody since 15.09.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge2nd-cum-Special Judge, Excise Act, Madhubani in connection with Harlakhi P.S. Case No. 203 of 2018.
