2. The petitioner seeks bail in connection with Sohsarai P.S. Case No. 103 of 2024 instituted for the offences under Sections 302/34 of the Indian Penal Code.
3. Allegation against the petitioner is of being involved in the commission of murder of the deceased Karu Kumar.
4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Petitioner is not named in the F.I.R. The name of the petitioner
Patna High Court CR. MISC. No.64592 of 2024(3) dt.20-11-2024 2/3 transpired in this case on the basis of suspicion. No incriminating article has been recovered from the conscious possession of the petitioner. There is no eye-witness to the occurrence. Learned counsel further submitted that except confessional statement, there is no material against the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.04.2024 and has no criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned counsel further submitted that petitioner himself has confessed his guilt before the police. Learned counsel further submitted that post-mortem report also supports the manner in which the accused persons committed the murder of the deceased as per the confessional statement of this petitioner.
6. Considering the aforesaid facts and circumstances of the case and nature and gravity of offence, this Court is not inclined to grant bail to the petitioner.
7. Prayer for grant of bail is rejected.
8. Learned trial Court is directed to expedite the trial.
9. However, if the trial is not concluded within a period of six months from today, petitioner will be at liberty to
Patna High Court CR. MISC. No.64592 of 2024(3) dt.20-11-2024 3/3 renew his prayer for grant of bail.
