JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-09-2025 Both these cases arise out of the same case i.e. Mithanpura P.S. Case No. 64 of 2025 and accordingly, they are being heard together and disposed of with this common order.

2. Heard learned counsel for the petitioners and learned APP for the State.

4. The petitioners are apprehending their arrest in a case registered under Sections 318(4), 338, 336(3), 340(2), 61(2) of the B.N.S.

5. The petitioners are contractors who installed submersible pump in the premises of schools. According to allegation, the contractors and the Junior Engineers after making forgery of signature of headmaster had withdrawn the money on the basis of forged bill.

6. It has been submitted on behalf of the petitioners that the status of the petitioners is merely of contractors and they have performed the work assigned by the department. The payment was made to the petitioners by the department. It has further been submitted that the Junior Engineers namely, Saket Ranjan and Sanjay Kumar have been granted anticipatory bail by a co-ordinate bench of this court.

7. Learned counsel appearing for the State has opposed the prayer for anticipatory bail.

8. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like
