The petitioners apprehend their arrest in Mohania P.S. case No. 31 of 2017 under Section 366 of the Indian Penal Code.
The informant alleged that his wife had gone to attend computer classes but she did not return. During the course of search witness disclosed that his wife was seen going with Balwant Sahani.
The learned counsel for the petitioners submits that petitioners are brothers and sisters-in-law of Balwant Sahani. The victim made her statement under Section 164 of the Cr. P. C. and she disclosed that she went along with Balwant Sahani and Muni Choudhary, who had assured her to get her engaged in a company,
Patna High Court Cr.Misc. No.28577 of 2017 (3) dt.19-08-2017 2/2 and they took her to Bangalore. The victim further disclosed that Balwant Sahani was talking to his brother and his sister-in-law and Balwant Sahani disclosed that they brought the girl and requested his brother to arrange for selling the girl. The learned counsel for the petitioner further submits that save and except the fact that petitioners are brothers and sisters-in-law of Balwant Sahani, there is absolutely no material against the petitioners.
Considering the facts aforesaid and the nature of allegation made against the petitioners and the fact that petitioners are brothers and sisters-in-law of Balwant Sahani, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S. case No. 31 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
