The petitioner apprehends arrest in connection with Budha Colony P.S. Case No. 343 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Only on the confessional statement of co-accused, petitioner's name has been transpired in the instant case. Further he submits that petitioner is not the owner of the alleged vehicle. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of the

Patna High Court CR. MISC. No.477 of 2022(2) dt.06-05-2022 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Special Judge, Excise Act, Patna in connection with Budha Colony P.S. Case No. 343 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
