The petitioners apprehend their arrest in Complaint Case No. 338/2014, registered for the offences punishable under Sections 406, 323, 379, 504, 341 and 420 of the Indian Penal Code.
The complainant alleged that while he along with his family members was going to a doctor then the petitioners intercepted him and forcibly took his signature on a plain paper after assaulting him. Accused persons also took the signature of his wife and snatched the bag containing Rs. 5,000/- Learned counsel for the petitioners submits that there
Patna High Court Cr.Misc. No.26080 of 2017 (2) dt.13-07-2017 2/2 is a series of litigations between the parties. It is submitted that from perusal of Annexure-9 page 99 of the bail petition it appears that a Panchayati was held. The complainant had taken different articles worth Rs. 20 lacs from the petitioner and others and in the Panchayati the complainant agreed to pay the entire amount within one month, failing which, the property of the complainant will be realized. In order to save his own skin, the complainant filed this case. The complainant had earlier given file cheques in lieu of payment of money, but the cheques were bounced.
Considering the nature of allegations made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Patna City in connection with Complaint Case No. 338/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
