The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 469, 479, 409 of the Indian Penal Code. The prosecution case is that the petitioner took Rs. 1,23,223/- as K.C.C. loan on the basis of forged Land Possession Certificate and rent receipt.
It is submitted by the learned counsel for the petitioner that petitioner has already returned all the loan amount, thereafter the present case has been lodged. Furthermore, that for the same accusation, earlier State Government lodged Special Case no. 01 of 2014, arising out of Vigilance P.S. Case No. 84 of 2013 wherein the petitioner has been granted anticipatory bail vide Cr. Misc. No. 51120 of
Patna High Court Cr.Misc. No.1849 of 2016 (2) dt.15-01-2016 2014. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 342 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
The bail bond of the petitioner shall be accepted provisionally till it is verified that petitioner has returned the loan amount.
