Petitioner claims that the lands of Kheshra No. 517/60-61-62 belonging to Tauzi No. 2938, Thana No. 140, sonepur, Pragana Kasmar, District Saran is his ancestral land which was submerged in the river Ganges and now it has come out from the river and is fit for agricultural purposes but, despite several attempt being made, the Circle Officer is not granting rent receipt though jamabandi was earlier running in the name of his grandfather, namely, Achuta Singh.
It is being submitted that the old Register II is missing from the office on which petitioner has apprehension that
Patna High Court CWJC No.4687 of 2015 (2) dt.23-06-2015 2/2 the same has been deliberately done. He claims that he had approached the District Magistrate, Saran at Chapra also by filing representation contained in Annexure 2 but no decision has taken as yet.
In above view of the matter, this Court grants liberty to the petitioner once again to approach the Collector - cum - District Magistrate, Saran at Chapra by filing a representation along with copy of documents as well as a copy of this order. On such representation having been filed, let the District Magistrate, Saran take a decision after necessary inquiry on its own merit and in accordance with law within a period of three months from the date of filing of such representation.
This disposes of the writ application.
