JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report with allegation that when the vehicle of the informant was damaged and the occupants scattered, the petitioner and his associates were fleeing away raising slogan " Lal Salam". The alleged occurrence is said to have taken place in the year 2009 and the petitioner could be remanded in this case in the year 2013. Moreover, the impugned order suggests that the trial of the petitioner has already commenced.

Taking note of the aforesaid facts as well as submission of the parties and also keeping in mind the criminal antecedent of the petitioner, I am not inclined to grant privilege of bail to the

Patna High Court Cr.Misc. No.1765 of 2016 (2) dt.18-01-2016 2/2 petitioner and accordingly, his prayer for bail in connection with Session Trial no. 108 of 2014 arising out of Maker P.S.Case No. 43 of 2009, pending in the court of Additional Sessions Judge-III, Saran, Chapra stands rejected, at least, at this stage.
