The petitioner being the Headmaster of the Upgraded Middle School, Garhtola, Barhiya is apprehending his arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code.

It is alleged that the petitioner being the Headmaster misappropriated Rs. 4,75,818/- with regard to construction of the school building.

It is submitted by the learned counsel for the petitioner that subsequently suspnsion of the petitioner has been revoked and the District Programme Officer, Lakhisari vide memo no. 1290 dated 04.04.2015 directed the In-charge

Patna High Court Cr.Misc. No.14075 of 2015 (2) dt.11-05-2015 Headmaster to release the balance fund to enable the petitioner to complete the construction work.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Barhiya P.S. Case No. 116 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
