Petitioner is in custody in connection with Siwai Patti P.S. Case No. 53 of 2018 for the offence under sections 341, 342, 324, 325, 307 & 120(B)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that in the instant case there is inordinate delay of one month in lodging the FIR. The occurrence is dated 5.6.2018 whereas Fard-beyan was recorded on 6.7.2018.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody since 30.8.2018.

Considering the fact that petitioner has no criminal antecedent and he is in custody since 30.8.2018 and there is

No.80287 of 2018(2) dt.30-01-2019 2/2 delay of one month in lodging the FIR, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. cum Sub Judge-IX, Muzaffarpur, in connection with Siwaipatti P.S. Case No. 53 of 2018.
