JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-03-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code.

As per the prosecution case, the informant received information that his brother has been stabbed to death by this petitioner Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Informant is not an eye witness of the occurrence and he has not disclosed the identity of the person from whom he got information about stabbing of his brother and only on suspicion petitioner has been made accused in this case. Petitioner claims

Patna High Court CR. MISC. No.140 of 2022(3) dt.24-03-2022 2/2 clean antecedent and is in custody since 01.09.2018 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail and submits that knife used in the crime has been recovered from the possession of this petitioner. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
