JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-04-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Jamui Police Station Case No. 283 of 2014 registered for the offences punishable under Sections 304B and 328 of the Indian Penal Code.

Petitioners happen to be in-laws of the deceased whose marriage had been taken place three years ago and after marriage, she given birth to a child.

From perusal of the impugned order, it would appear that in course of investigations, some witnesses stated that after

Patna High Court Cr.Misc. No.14488 of 2015 (2) dt.07-04-2015 2/2 birth of a child, the deceased had developed some complications for which her treatment was going on and in course of treatment she died in hospital. Furthermore, the impugned order reveals that the doctor could not ascertain the cause of death of the deceased and viscera was kept reserved.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in Jamui Police Station Case No. 283 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
