JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 307, 386 and other minor sections of the IPC and section 27 of the Arms Act.

The accusation against the petitioner is that he along with others went to the shop of the informant and demanded extortion money and FIR named accused Sonu Yadav opened fire on the informant. However, informant and others caught the petitioner and badly assaulted him.

Submission on behalf of the petitioner is that the petitioner has falsely been implicated in this case and, as a matter of fact, he had gone to the shop of the informant to

It is also submitted that the petitioner does not have any criminal antecedent and is languishing in jail custody since 23.8.2018.

Considering the facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Purnea in sessions trial no.421/2018 arising out of K.
