JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 17-02-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in a case registered for the offence punishable under sections 323, 379, 498A of the Indian Penal Code.

As per allegation in the complaint petition, petitioner has tortured in various ways to the informant due to nonfulfillment dowry demand and finally he in connivance with his family members ousted her after snatching her belongings. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is husband of the informant and has been falsely implicated in this case. All the allegations levelled

Patna High Court CR. MISC. No.63114 of 2022(2) dt.17-02-2023 2/2 against is baseless. He has never demanded any thing from the informant. Only with a view to harass the petitioner, informant has lodged the present case against him. He is languishing in judicial custody since 14.04.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupri, Sitamarhi in connection with Complaint Case No. C1/351/2018.

The informant will be at liberty to file appropriate application for redressal of her grievance before the appropriate forum.
