Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bhagwanpur P.S. Case No. 188 of 2021 lodged under Sections 302, 201, 120(B) of the I.P.C.

As per the prosecution case, the dead body of one male and one female was recovered. Upon identification of the dead body, the relatives of both the accused persons were made accused in the F.I.R. including the petitioner. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Learned counsel submits that the petitioner is the uncle of the deceased female. Counsel further submits that there is no eye witness of

Patna High Court CR. MISC. No.62286 of 2022(2) dt.22-02-2023 2/2 the said occurrence. The name of family of both the deceased have been made accused only and only on the basis of suspicion. Counsel submits that antecedent of the petitioner is clean and he is in custody since 23.07.2022.

Counsel further submits that the other co-accused persons who are alleged to be the family member of the deceased have been granted bail by this Court vide order dated 18.10.2022 and 07.12.2022 passed in Cr. Misc. No.2207 of 2022 and Cr. Misc. No.34 of 2022 with analogous cases. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 188 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
