ANJANA MISHRA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

Diary in this case was called for earlier which has since been received.

Allegation against the petitioner is that he along with other brothers-in-law of the deceased indulged in an act leading to or conspired to kill the girl Ruchi Raj. The informant of this case is cousin brother whereas the petitioner is the eldest brother-in-law of the deceased Ruchi Raj.

Learned counsel appearing on behalf of the State after perusal of the case diary submits that there is no specific allegation

Patna High Court Cr.Misc. No.3959 of 2016 (3) dt.06-05-2016 P2/2 or even a remote reference to the present petitioner of having participated in the offence.

Considering that there is no cogent material in the case dairy to implicate the petitioner, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Kotwa P.S. Case No. 306/2013, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
