Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 392 of the Indian Penal Code and 27 of the Arms Act. It is alleged that the petitioner pointed pistol on the temporal region of the informant, when the informant after withdrew money through A.T.M. Card was coming home. Coaccused Bhageran took out Rs. 9500/- from the pocket of the informant.

It is submitted by the learned counsel for the petitioner that for the occurrence of 20.06.2015 the complaint was filed on 24.06.2015 which came to be registered as police case on 04.08.2015. At earlier point of the time the informant lodged a criminal case against the son of the petitioner.

Patna High Court Cr.Misc. No.2975 of 2016 (2) dt.19-01-2016 Petitioner is 64 years old person and due to old enmity accusation has been levelled. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Bhagwanpur Hat P.S. Case No. 137 of 2015, pending in the court of learned Sri Manoj Kumar Srivastava, J.M., Siwan.

With this observation this application is disposed of.
